What Type of Case is Drunk Driving?
Drunk driving is a criminal offense that occurs when a vehicle driver has a blood alcohol concentration (BAC) exceeding the legal limit, generally set at 50 milligrams percent.
This offense violates traffic laws and alcohol control laws, and it carries severe penalties to prevent accidents and damages that can arise from driving a vehicle under the influence.

1. Imprisonment: Up to 1 year.
The court may sentence the offender to imprisonment for a period of up to 1 year, depending on the severity of the offense and the offender’s history of violations.
2. Fines: Between 5,000 to 20,000 THB.
The offender will be fined an amount within this range, as determined by the court.
The fine is typically based on the level of alcohol in the blood, the circumstances of the offense, and the impact of the offense.
3. Administrative Penalties
Suspension of the driver’s license for up to 6 months. For first-time or less serious offenses, authorities may temporarily suspend the driver’s license for up to 6 months.
4. Revocation of Driver’s License
In cases of repeat offenses or serious violations, authorities may revoke the offender’s driver’s license.
5. Participation in Rehabilitation Programs
The court may order the offender to participate in a rehabilitation program, which involves education and behavioral modification to prevent future offenses.
Fines for Exceeding Alcohol Limits?
If an individual is found to have a BAC exceeding the legal limit, the fine will be in accordance with the aforementioned penalty range.
For first-time offenders who have not caused an accident, the fine will generally be on the lower end of the range
starting at approximately 5,000 THB.
However, for repeat offenders or if the drunk driving led to an accident, the fines will be higher and may also include imprisonment.
Motorcycle drunk driving fine in 2023
1. Imprisonment
Up to 1 year, similar to driving a car.
